Terms of Service

These terms are an agreement between you and Upwind (“Upwind”, “we”, “us”), operated from New Zealand. By creating an account or using the service you agree to them. If you don’t agree, please don’t use the service.
1. What Upwind is
Upwind is a hosted service that lets you build, edit, and publish a website, capture enquiries from it, and manage that site yourself. Features may change or improve over time.
Some customers come to us through a CoreShift partner who built their site. Either way, your contract is with CoreShift and these terms apply. A partner who built your site may keep access to help you edit it; you can ask us to remove that access at any time.
2. Your account
- You sign in with a Google account. You’re responsible for activity under your account and for keeping access secure.
- You must be able to form a binding contract and use the service only for lawful purposes.
- You must give accurate information and keep it up to date.
3. Your content
- You own your content — the text, images, and other material you add to your site remain yours.
- You grant us the licence needed to host, store, process, and display that content so we can provide the service.
- You’re responsible for your content: you must have the rights to use it, and it must not be unlawful, infringing, deceptive, or harmful.
4. Acceptable use
Don’t use Upwind to publish illegal, fraudulent, or malicious content; to send spam; to infringe others’ rights; to attempt to break, overload, or gain unauthorised access to the service; or to resell the service without our agreement. We may suspend or remove sites that breach these terms.
5. Plans, trial, and fees
- Building and previewing is free. Publishing a site starts a 14-day free trial.
- After the trial, keeping your site live requires a subscription: US$49 per month or US$499 per year (prices exclusive of GST unless stated; displayed in your local currency at checkout where supported). We may change pricing with notice for future billing periods.
- Subscriptions renew automatically until cancelled. Payments are processed by Stripe; by subscribing you also agree to Stripe’s terms.
- If a payment fails, we may suspend the site until it’s resolved.
6. Cancellation
You can cancel any time from your dashboard billing settings. See our Refunds & Cancellation policy for what happens to access and charges.
7. Availability
We work to keep the service running reliably but don’t guarantee uninterrupted or error-free operation. We may perform maintenance, and we may modify or discontinue features. Published sites are served through third-party infrastructure (see our Privacy Policy).
8. Custom domains
If you connect your own domain, you’re responsible for owning it and for any registrar charges. Domain connection depends on third-party DNS and certificate services and may take time to activate.
9. Liability
To the extent permitted by law, the service is provided “as is”, and Upwind is not liable for indirect or consequential loss, lost profits, or lost data. Our total liability for any claim is limited to the amount you paid us in the three months before the claim. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot lawfully be excluded.
10. Termination
You can stop using the service at any time. We may suspend or terminate access for breach of these terms. On termination your right to use the service ends; you can request an export of your content beforehand.
11. Changes
We may update these terms; material changes will be notified through the service or by email. Continuing to use Upwind after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
